Wine Symphony is an online sales service for alcoholic beverages.
Users using the services offered by Wine Symphony declare that they know and accept these general contract terms.
The sale of alcoholic beverages is forbidden to minors.
Wine Symphony users claim to be of age according to their applicable legislation.
Users are responsible for their own content and third parties who share on Wine Symphony, by uploading them, by inserting content or by any other means. Users withdraw the Owner from any liability in connection with the illegal dissemination of third party content or the use of Wine Symphony, in ways contrary to law.
The Owner does not conduct any kind of content moderation by the user or by third parties, but commits himself to intervene in the face of User notices or orders issued by public authorities in relation to content considered offensive or illegal.
All prices quoted on the site are subject to periodic variations without prior notice.
Each order submitted is an offer to purchase the products posted on the site. Orders are subject to availability and discretionary acceptance by the Owner, who reserves the right to not confirm an order, in particular due to the unavailability of one or more of the products purchased. In this case, the Owner will reimburse to User the price and shipping costs.
Actual availability of a product is indicative, as multiple users can purchase it at the same time and make a product that another user has already put into the cart, unavailable.

The payment must be made to Wine Symphony di Lupi Francesco and as causal must be reported the order number. Payment must be made within 5 working days of the order, after this deadline the unpaid order will be deemed invalid and then canceled.
Any payment charges will be charged to the Customer.
In the event that, for any reason, the debiting of the amounts due by the Customer becomes impossible, the sales process is automatically canceled and the sale automatically canceled.
Products purchased at www.eng.winesymphony.it will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request the delivery of the products to an address of their choice. At the time of delivery, the signature of an adult older than 18 years will be required. No deliveries will be made to postal boxes.
For each order made on the www.eng.winesymphony.it website, Wine Symphony by Lupi Francesco issues invoice of the goods shipped, mailed to him or by order, according to D.P.R. 445/2000 and Legislative Decree 52/2004. The information provided by the Customer on the order is credited to the invoice. No change in invoice will be possible after issuing the same.
Delivery costs are the responsibility of the Customer and are clearly indicated on the Site and in the Order Form.
All purchases will be delivered via express courier GLS, FEDEX or UPS.
Wine Symphony by Lupi Francesco is not responsible for unpredictable delays.
Wine Symphony by Lupi Francesco or the designated express courier will send a confirmation email to the Customer once the Products are shipped, specifying the tracking number of the shipment through which it will be possible to view, upon entering the forwarder website, the status of shipment.
For the delivery of the goods, the presence of the Customer or a person in charge of the address of the recipient indicated in the order is required. At the time of delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is stated in the shipping document and that the package is intact or not altered.
Any damage to the Package and/or the Products or the failure to match the number of packages must be immediately disputed by means of a written checkout on the courier delivery proof. Once the forwarder document has been signed, the Customer will not be able to complain any of the external features of the parcel delivered.
Wine Symphony di Lupi Francesco wishes to guarantee the complete satisfaction of the Client.
Pursuant to Article 64 of the Consumer Code, Customer has the right to terminate the contract without specifying the reason for returning the Products purchased through the Site within 10 (ten) business days from the date of receipt of the Products .
In order to exercise the right of withdrawal, the Customer must send to the following address: Via Francesca Sud 112/F, Castelfranco di Sotto (PI) 56022 a communication containing:
(A) the manifestation of the will to avail itself of the right of withdrawal pursuant to art. 64 of the Consumption Code;
B) the indication of the Products for which the Customer wishes to use the right of withdrawal;
(C) the order number issued at the time of purchase;
D) all payment details
Such communication can be sent within 10 (ten) days, including by e-mail, telegram and fax.
In the event of exercise of the right of withdrawal, Wine Symphony di Lupi Francesco will fully refund the price of the Products provided that they are returned by the Customer in normal state of preservation and only if the instructions given above will be properly respected. Wine Symphony di Lupi Francesco reserves the right to refuse the return of those products which do not comply with these requirements. Refunds will be made using the same payment method used for the purchase or by bank transfer.
Delivery costs for the return of the Products are the responsibility of the Customer; Any costs incurred by Customer for redeeming will not be refundable.

The legal guarantees provided for in Articles 129, 130 and 132 of the Consumption Code apply to the sale of the Products. The Customer is entitled to the repair, replacement of the goods, or to a proper reduction of the price or termination of the contract. The Customer is deprived of these rights if he does not declare to the Wine Symphony di Lupi Francesco the defect of conformity within two months from the date on which he discovered the defect. The action directed at claiming the defects which are not well-concealed by Wine Symphony by Lupi Francesco, however, prescribes, in any case, within the period of twenty-six months after the delivery of the good.
